Evidence in support of application
42.
—(1)  Within 2 months from the date the applicant receives the counter-statement from the registered owner, the applicant shall file with the Registrar such evidence by way of a statutory declaration as he may desire to adduce in support of his application and shall, at the same time, send to the registered owner a copy of that evidence.

(2)  If the applicant does not file any evidence in accordance with paragraph (1), he shall, unless the Registrar otherwise directs, be deemed to have withdrawn the application.
