Failure to disconnect equipment not approved under section 9
52.  Where —
(a)
any person has under his control a telecommunication system or equipment connected to the telecommunication system or equipment of a telecommunication system licensee which is of a type not approved by the Authority under section 9;
(b)
the Authority has given to the person a written notice stating that —
(i)
the telecommunication system or equipment under his control is of a type that has not been approved by the Authority under section 9; and
(ii)
the person must disconnect the telecommunication system or equipment from the telecommunication system or equipment of the telecommunication system licensee within such period as specified in the notice; and
(c)
the person has failed to comply with any written notice under paragraph (b),
then the person shall be guilty of an offence.
