Parking Places (Licensing and Control of Private Parking Places) (Amendment) Rules 2005

In exercise of the powers conferred by section 8 of the Parking Places Act, the Land Transport Authority of Singapore, with the approval of the Minister for Transport, hereby makes the following Rules:

Citation and commencement

1. These Rules may be cited as the Parking Places (Licensing and Control of Private Parking Places) (Amendment) Rules 2005 and shall come into operation on 1st April 2005.

Amendment of title

2. The Parking Places (Licensing and Control of Private Parking Places) Rules (R 1) (referred to in these Rules as the principal Rules) are amended by inserting, immediately after the words “PRIVATE PARKING PLACES” in the title, the words “FOR HEAVY VEHICLES”.

Amendment of rule 1

3. Rule 1 of the principal Rules is amended by inserting, immediately after the words “Private Parking Places”, the words “for Heavy Vehicles”.

Amendment of rule 2

4. Rule 2 of the principal Rules is amended —

(a)

by deleting the words “section 3” in the definition of “competent authority” and substituting the words “section 5”; and

(b)

by deleting the full-stop at the end of the definition of “person” and substituting a semi-colon, and by inserting immediately thereafter the following definition:

“ “private parking place” has the same meaning as in section 2 of the Act in so far as it relates to the parking or housing of one or more heavy vehicles.”.

Amendment of rule 4

5. Rule 4 of the principal Rules is amended —

(a)

by deleting paragraph (2) and substituting the following paragraph:

“(2) Application for a licence to maintain or operate a private parking place shall be made to the Superintendent in the approved form accompanied by —

(a)

a plan approved by the competent authority; or

(b)

such plan as the Superintendent may require,

(c)

showing the location, dimension and capacity of such parking place together with details as to the level thereof, the entrances thereto and exits therefrom.”; and

(b)

by deleting paragraph (4) and substituting the following paragraph:

“(4) The Superintendent may require the applicant to furnish information relating to the operation and management of the relevant private parking place and such other matters as the Superintendent may think fit.”.

Amendment of rule 5

6. Rule 5(2) of the principal Rules is amended by deleting the words “parking place” wherever they appear and substituting in each case the words “private parking place”.

Amendment of rule 5A

7. Rule 5A of the principal Rules is amended by deleting paragraph (1) and substituting the following paragraph:

“(1) Subject to paragraph (3) and rule 7, the duration of a licence granted under these Rules shall be such period as the Superintendent may determine.”.

Amendment of rule 5B

8. Rule 5B(1B) of the principal Rules is amended by deleting the words “parking place” wherever they appear and substituting in each case the words “private parking place”.

Amendment of rule 7

9. Rule 7 of the principal Rules is amended by deleting paragraph (5).

Deletion of rule 9

10. Rule 9 of the principal Rules is deleted.

Deletion and substitution of First Schedule

11. The First Schedule to the principal Rules is deleted and the following Schedule substituted therefor:

“FIRST SCHEDULE

Rule 6(1)

fee

For the grant or renewal of a licence in respect of a private parking place whether temporary or permanent

$1 per month for each motor lorry lot or each lot or space designated for the parking of a heavy vehicle.”.

Amendment of Second Schedule

12. Paragraph 8 of the Second Schedule to the principal Rules is amended by deleting the words “Only such fees and charges as are approved by the Superintendent shall be displayed on the signboard.”.
