5. Section 16 of the Pensions Act is amended —
(a)
by inserting, immediately after the words “pensionable office” in subsection (1)(a), the words “who has not exercised an option mentioned in section 3(1A)”;
(b)
by inserting, immediately after paragraph (a\) of subsection (1), the following paragraph:
“(b)
in the case of an officer holding a pensionable office who has exercised an option mentioned in section 3(1A), one year’s salary as at the date immediately prior to his option taking effect or the commuted pension gratuity which might have been granted to the officer if he had retired at the date of his death in the circumstances described in section 7(2)(c), whichever is the greater;”;
(c)
by re-lettering the existing paragraph (b) as paragraph (c);
(d)
by inserting, immediately after the words “pensionable office” in the sixth line of subsection (2), the words “who has not exercised an option mentioned in section 3(1A)”; and
(e)
by inserting, immediately after the word “gratuity” in the definition of “one year’s salary” in subsection (5), the words “, or in the case of an officer holding a pensionable office who has exercised an option mentioned in section 3(1A) any pension, which may be”.
