—(1) If any member of the Corps unlawfully absents himself from duty under circumstances which show that he has the intention of not returning to his duty, he shall be deemed to have deserted and shall be guilty of an offence and shall be liable on conviction to imprisonment for a term not exceeding 12 months.
(2) Any police officer may arrest without warrant any person where there are reasonable grounds to believe that that person is guilty of an offence under subsection (1).
