Town Council of West Coast (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges and Licence Fees) By-laws 2006
In exercise of the powers conferred by section 24 (2)(a) and (c) of the Town Councils Act, the Town Council for the Town of West Coast hereby makes the following By-laws:
1. These By-laws may be cited as the Town Council of West Coast (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges and Licence Fees) By-laws 2006 and shall come into operation on 1st August 2006.
2. Where any conservancy and service charge or licence fee payable by any tenant, owner or licensee to the Town Council is in arrears for one month or one year, as the case may be, the tenant, owner or licensee shall be liable to pay to the Town Council for every month or year, as the case may be, in which there is an arrear a penalty at the appropriate rate specified in the Schedule and the penalty shall become due and payable on the day following the expiry of that month or year.

—(1) Where any conservancy and service charge or licence fee or any part thereof remains unpaid for a period of 4 months or more from the date on which it was due to be paid, the tenant, owner or licensee shall, in addition to any penalty which may be imposed under by-law 2, be liable to pay to the Town Council an administrative fee of $40.
(2) The tenant, owner or licensee shall not be liable to pay the administrative fee referred to in paragraph (1) more than once in respect of the same period of 4 months or part thereof.
4. Nothing in these By-laws shall prejudice any right of action or other remedy of the Town Council under any licence agreement entered into between the Town Council and any licensee.
5. The Town Council may, in its discretion, apply any moneys paid by the tenant, owner or licensee under these By-laws firstly towards the payment of the amount of any penalty or administrative fee payable under these By-laws and subsequently apply any balance thereof towards payment of any amount of conservancy and service charge or licence fee or part thereof which is in arrears.
6. The Town Council may, in its discretion, remit wholly or in part any penalty or administrative fee payable under these By-laws.
