—(1) On the close of nominations, if the valid nominations received by the returning officer is less than the vacancies to be filled, he shall declare the candidates nominated to be elected.
(2) If the returning officer receives more valid nominations than there are vacancies to be filled, a secret ballot shall be held for the contested seats.
