2. In these Rules, unless the context otherwise requires —
“driver” —
(a)
in relation to a motor vehicle, means the person driving or in charge of the motor vehicle; and
(b)
in relation to a trailer, means the person driving or in charge of the motor vehicle to or by which the trailer is attached or drawn;
“owner”, in relation to a motor vehicle or trailer, means —
(a)
each person who is the owner, joint owner or part owner of the motor vehicle or trailer; or
(b)
a person who has the use or control of the motor vehicle or trailer under a credit agreement, hiring agreement, hire-purchase agreement or leasing arrangement,
but does not include the driver of a motor vehicle or trailer when the driver has been provided as part of a hiring agreement for the motor vehicle or trailer.
