16.
—(1) Upon consideration of the report of the Investigation Committee, the Disciplinary Committee may order —
(a)
in the case of a member —
(i)
that his name be removed from the register and that he shall cease to be a member;
(ii)
that his registration as a member be suspended for such period as the Investigation Committee may recommend;
(iii)
that he be fined a sum not exceeding $5,000;
(iv)
that he be censured;
(v)
that notwithstanding the Investigation Committee’s findings, no further action be taken on the case; or
(vi)
that he obtains advice or professional assistance from such source as the Disciplinary Committee thinks appropriate;
(b)
in the case of a student —
(i)
that he be declared unfit to be a student and that he be removed from the student register or that his registration as a student be suspended for such period as may be recommended by the Investigation Committee;
(ii)
that any period as may be recommended by the Investigation Committee be not recognised as part of the student’s professional experience;
(iii)
that he shall not sit for any examination or examinations of the Institute for such period as may be recommended by the Investigation Committee;
(iv)
that the results of any examination or examinations of the Institute sat by him be withheld from him permanently or, if he has been notified of them, that they be deemed to be void;
(v)
that he be censured; or
(vi)
that, notwithstanding the Investigation Committee’s findings, no further action be taken on the case.
(2) The Disciplinary Committee may order the member or student concerned to pay to the Institute such sums as it thinks fit in respect of costs and expenses of and incidental to any investigation and inquiry.
(3) Any penalty imposed or costs and expenses incurred by the Institute under this section shall be recoverable as a debt due to the Institute.
(4) The Disciplinary Committee may, where it thinks fit, require an Investigation Committee to consider further evidence and meet for that purpose except that the member or student concerned shall be given not less than 14 days’ notice of such further meeting of the Investigation Committee.
