HIRE-PURCHASE AGREEMENTS
HIRE-PURCHASE AGREEMENTS
1. These Rules apply to proceedings under the Hire-Purchase Act (Chapter 125) subject to the following Rules.
2. An application under section 5 (3), 10, 32, 43 or 44 of the Hire-Purchase Act must be made by originating summons supported by an affidavit stating the grounds of the application.
3. Where the plaintiff’s claim is for the recovery of money arising out of a hire-purchase agreement, he must, in his statement of claim, give the following particulars:
(a)
the date of the agreement and the parties thereto;
(b)
the goods let under the agreement;
(c)
the amount of the hire-purchase price;
(d)
the amount paid by or on behalf of the hirer;
(e)
the amount (if any) claimed as being due and unpaid in respect of any instalment or instalments of the hire-purchase price; and
(f)
the amount of any other claim and the circumstances in which it arises.
