40. For the avoidance of doubt, section 2(b) and (c) of this Act (which amends section 2(7) of the Insurance Act) shall not affect —
(a)
any act of any company engaged primarily in the business of export credit insurance, or of any of its agents, which was done before the date of commencement of section 2(b) and (c) of the Insurance (Amendment) Act 2001; or
(b)
any policy, or contract of insurance where an insurance is effected, which was made with such a company before the date of commencement of section 2(b) and (c) of the Insurance (Amendment) Act 2001.
