Supply and use of health products and active ingredients for veterinary purposes
73.
—(1)  The Minister charged with the responsibility for national development may make regulations in relation to the supply or use for veterinary purposes of —
(a)
any health product (whether or not such health product falls within any of the categories of health products specified in the First Schedule); or
(b)
any active ingredient.
(2)  Regulations made under subsection (1) may —
(a)
prohibit the supply or use of any health product or active ingredient for any veterinary purpose, whether absolutely or subject to such exceptions as may be prescribed;
(b)
require that the supply or use of any health product or active ingredient for veterinary purposes should be made only in accordance with the prescription of a veterinarian;
(c)
provide for such other restrictions or controls on the supply or use of any health product or active ingredient for veterinary purposes;
(d)
provide that a contravention thereof shall be an offence punishable with penalties not exceeding a fine of $20,000 or imprisonment for a term of 12 months or both; and
(e)
provide for the administration and enforcement of such regulations by officers of the Agri-Food and Veterinary Authority.
(3)  All regulations made under this section shall be presented to Parliament as soon as possible after publication in the Gazette.
Powers of officers enforcing regulations made under section 73
74.  An officer of the Agri-Food and Veterinary Authority administering and enforcing any regulations made under section 73 shall have the same powers as are conferred on an enforcement officer by section 49.
Application of Parts X to XIII
75.  The provisions of Parts X to XIII shall, where relevant, apply with the following modifications to the administration and enforcement of any regulations made under section 73:
(a)
any reference in the provisions of those Parts to the Minister shall be read as a reference to the Minister charged with the responsibility for national development;
(b)
any reference in the provisions of those Parts to the Authority shall be read as a reference to the Agri-Food and Veterinary Authority;
(c)
any reference in the provisions of those Parts to the Chief Executive shall be read as a reference to the Chief Executive of the Agri-Food and Veterinary Authority;
(d)
any reference in the provisions of those Parts to an enforcement officer shall be read as a reference to an officer of the Agri-Food and Veterinary Authority who is acting in the administration and enforcement of such regulations; and
(e)
any reference in the provisions of those Parts to a health product shall include any health product that does not fall within any of the categories of health products specified in the First Schedule.
